Es werden so genannte Reseller-Rechte vergeben. Nur autorisierte Partner sind berechtigt, Softwarelizenzen zu verkaufen, und sind obligatorische Mitglieder des Partnerprogramms des Herstellers. Wiederverk\u00e4ufer erhalten das nicht-exklusive Recht, lizenzierte Software innerhalb der EU\/EFTA aktiv zu vermarkten und zu vertreiben. Vertriebspartner k\u00f6nnen jedoch auch in anderen Regionen t\u00e4tig werden, dies bedarf einer schriftlichen Vereinbarung.<\/p>\n<p>Der Distributor ist verpflichtet, die Softwareprodukte unter dem jeweiligen Produktnamen des Herstellers anzubieten. Eigentumsrechte und einschl\u00e4gige Copyright-Hinweise sind zu beachten bzw. zu befolgen. Alle Warenzeichen und eingetragenen Warenzeichen sind Eigentum der jeweiligen Hersteller. Die technischen Informationen m\u00fcssen immer mit den Herstellerangaben \u00fcbereinstimmen. Bilder, Piktogramme und Logos werden zur Identifizierung der Artikel verwendet. Die verkauften Waren bleiben bis zur vollst\u00e4ndigen Bezahlung im Eigentum des H\u00e4ndlers.<\/p>\n<p><span style=\"font-size: 20px\"><strong>Zulassungsrecht<\/strong><\/span><\/p>\n<p>Nach der aktuellen Rechtsprechung des Bundesgerichtshofs (BGH, Urteil vom 17. Juli 2013 - I ZR 129\/08) sind Fachh\u00e4ndler verpflichtet, die Rechtm\u00e4\u00dfigkeit und Ordnungsm\u00e4\u00dfigkeit der angebotenen Software zu dokumentieren. Softwarelizenzen d\u00fcrfen nur mit Zustimmung des Rechteinhabers in den Verkehr gebracht werden. Die Lizenz wird gegen ein Entgelt erteilt, das es erm\u00f6glicht, eine dem wirtschaftlichen Wert der Software entsprechende Verg\u00fctung zu erzielen. Der Rechteinhaber verpflichtet den Vertreiber, die Software dauerhaft und ohne zeitliche Begrenzung f\u00fcr die Nutzung zu verkaufen. Der Verbraucher wird darauf hingewiesen, dass die Software den Lizenzbedingungen und Produktnutzungsrechten des Softwareherstellers unterliegt.<\/p>\n<p>Der K\u00e4ufer hat ein einfaches und unbegrenztes Recht, die Software zu nutzen. Es ist ihm nicht gestattet, sie zu kopieren oder anderen zur Nutzung zu \u00fcberlassen.
